Acceptance of terms

These terms and conditions govern all supply of goods and services (“products”) by Leisa McGill Appearance Coach (“we, “us”) to you, the purchaser of goods and services from us, including your use of the website at Appearance Coach (“the website”). They are effective from 29.11.22 and will replace all earlier Appearance Coach terms of trade and any conditions contained in any document used by you and purporting to have contractual effect.

We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.

To make a purchase from our online shop you must be 18 years of age or over.

Purchases from our online shop may only be made by persons who are acquiring goods or services for their own use or consumption, and you must not acquire goods from us via the website for resupply (whether in trade or otherwise).

If you are purchasing on behalf of another entity such as a company you warrant you have the authorisation to agree to these terms and conditions on behalf of the entity.

Availability and supply

All orders are subject to the availability of those products or services. If for any reason a Product is not available, we will endeavour to notify the non-availability on our online shop or contact you via contact information you have provided when purchasing from the website.

Delivery and delivery charges

Prices for goods and services stated on our website are exclusive of any applicable delivery charges.

We only deliver to New Zealand street addresses. The cost of delivery is as stated on our website and a total delivery cost will be provided in the order summary in your online shopping basket.

We will use all reasonable endeavours to ensure that orders for tangible goods will be dispatched promptly after an order has been placed.  We will endevour to send out out purchases within 3 working days of receiving the order.

Pricing

All prices are in New Zealand Dollars and are inclusive of any Goods and Services Tax (“GST”) unless stated to be otherwise but are exclusive of delivery charges. All prices are correct when published. We reserve the right to alter prices at any time.

An invoice will be emailed to you at the email address you supply when you place your order. You are responsible for ensuring that your contact details are correct.

Payment options

We accept the following credit cards:

We also accept payments through the third party Afterpay.

Credit Card Security

All payments are processed via Woocommerce secure payments system to ensure high levels of payment security and are subject to Woocommerce terms and conditions.

Shipping and delivery

 We use NZ Couriers for shipping and use tracking which is emailed to you.  Shipping is standard $7.50 urban and $11.90 rural.

Price on the website excludes shipping and is added at checkout.

Products will endevour to be sent out by 3 working days however we are not responsible for the delays once shipped.

Refund Policy

Appearance Coach recommends that you contact us for correct product and usage directions for your skin.

If you are not happy with a product you have purchased, please notify Appearance Coach with details of the problem within 30 days of receiving the product, and we will arrange a refund or replacement. Proof of purchase and return of the product is required in order to receive a refund or replacement.

To request a return, please provide the following:
• Name & address
• Email address
• Original order number
• The reason for the return

Cancellations

Once an order has been placed and paid for there is no cancellation available. Instead, you will need to contact us to request a return as outlined above.

 Liability Limitation

Where you acquire or hold yourself out as acquiring goods or services from us for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 will not apply. The conditions, warranties and guarantees set out in the Sale of Goods Act 1908 or otherwise implied by statute or common law will not apply and are excluded from these terms of trade.

We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.

To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993.

Our maximum liability to you (if any) shall be limited to the value of any faulty products or services supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises.

Applicable law and jurisdiction

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside.

Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services.

Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the purchase of a product or service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a solicitor-client basis).

You agree to use our website, products and services in accordance with the applicable laws of the country or countries where your business or organisation is based.

Privacy policy and Confidentiality

Unless you opt to receive messages from us we will not contact you again in future. If you have opted to receive ongoing communications and at a later date you no longer wish to receive these communications you will be able to opt out of receiving this information by contacting us by email or by following the unsubscribe instructions at the bottom of emails sent to you.

Opting out of receiving the above mentioned messages will not prevent the sending of messages that specifically relate to your order(s).

We may use personal information that we collect about you to provide products and services to you and to administer orders and payments relating to your purchases from us.

You will need to permit us to place data files (“cookies”) on your computer to enable you to use some features of some of our websites. Where you choose not to enable cookies from our Website, some functionality of those Website may not be available to you.

We may disclose your personal information as required by law.

Where you have provided information to us on a confidential basis, we will hold that information in confidence, except as required by law. We cannot guarantee that our website is secure, and we cannot be held responsible for a breach of our website security that is beyond our control.

You can request details of your personal information that we hold, and ask us to correct it, at any time.

General Conditions

We reserve the right to change these terms and conditions from time to time by notice, which may be in the form of a notice posted on our website at https://www.appearancecoach.co.nz

If we fail to enforce any terms or to exercise our rights under these terms and conditions at any time, we have not waived those rights.

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms and conditions.

Unless any provision in this agreement expressly provides otherwise, these terms and conditions are not intended to confer a benefit on any person or class of person who is not a party to it.

We may deliver notices to you by sending them to an email address that you have notified to us.

Cancellations 

Appearance Coach cancellation and no show policy:

We require a minimum of 24 hours notice of any appointment cancellation.  If an appointment is cancelled within 24 hours or you do not show to your appointment your deposit will be forfeited.  If you have not paid a deposit at time of booking you will be invoiced $50 or your held credit card on file will be charged.   If we receive notice to cancel your appointment prior to 24 hours before your scheduled appointment we will refund or apply it to your new appointment. By booking an appointment with Appearance Coach you are agreeing to these terms.

Appointments can not be transferred to another person.

Membership payments will be conducted by direct deposit or via the third party company GoCardless.com and Aglow.co

For membership cancellations, all treatments performed will need to be paid for before cancellation.

Results you achieve from your treatments  will vary from person to person, we can not guarantee results. Results hugely rely on our recommended skincare, supplement use and  lifestyle. We do not offer money back guarantee.

Please note:

  • No cancellations or changes within 24 hours of an appointment.
  • We reserve the right to keep your deposit if cancellations or you no show within this 24 hour period or if not deposut has been paid at time of booking and invoice will be sent or if a credit card is held on file, this will be charged the $50 fee.
  • In the case of emergency, sickness, or being asked to self-isolate by the Ministry of Health NZ, we will use our discretion as to whether a late fee is appropriate.

Reservation Deposit

All clients are asked to pay a non-refundable appointment reservation deposit to secure an appointment.

Regardless of how you book (online, in the clinic, or phone/email) you will be required to pay this deposit.

  • Paying your deposit is easy – you’ll be sent an email with a link to pay online or you can pay at reception at the time of booking (you will then have 48 hours to pay before the booking is cancelled) or deposit is charged directly through Timely when you book.
  • If you cancel late (within 24 hours of your appointment) or fail to show up, you won’t be entitled to a refund for this deposit. Instead, it will be absorbed to cover the costs incurred by missing your booked appointment with us.
  • If you move or cancel your appointment with appropriate notice (at least 24 hours notice) the deposit will automatically be placed in your client file as a credit. You can then use this credit for a future appointment or spend it on product.
  • All appointment reservation deposits are non-refundable.

Pricing

All prices are quoted in New Zealand dollars. Trade pricing excludes GST and consumer pricing includes GST. Prices may be adjusted for any reason, and may vary at any time.

Delivery

Orders will be sent out within three working days of placement. Shipping times vary based on customers area. Appearance Coach uses NZ Couriers for delivery. Delivery is only available within New Zealand.

Privacy Statement

Appearance Coach collects, retains and updates personal information about you which you provide both:
• directly, for example, by you sending us an email enquiring about information on Appearance Coach services or events, or to go on mailing lists; and
• indirectly through your use of this site and the services and functionality offered through it.
Appearance Coach intends to use this information for purposes connected with:
• providing, monitoring and marketing existing and future goods and services and related products by Appearance Coach
• keeping you informed of developments or opportunities in areas or activities you have previously been interested in or we believe you may be interested in.
• enabling Appearance Coach to satisfy itself as to the credit worthiness of customers.
Appearance Coach intends to provide overall statistics about users, site use, demand for relevant products, services, facilities and information, traffic patterns, and related site information to reputable third parties. These statistics will not include any information which personally identifies you. You are entitled to access and correct the personal information Appearance Coach holds about you at any time. You can request to be removed from any Appearance Coach mailing list or  emailing Unsubscribe. Your rights of removal may be subject to any additional terms which apply to the relevant list or service.

Shopping Security

We have taken every precaution to ensure your online shopping experience is enjoyable and secure. We protect your credit and personal details using Secure Socket Layer (SSL) encryption technology so that if anyone should try to intercept it, all details are unreadable. We also recommend as good internet practice to close your browser when you have completed your online shopping.

All credit card data is passed to our Gateway provider, WooCommerce. We do  retain complete credit card details on our website with your permission.

Intellectual Property rights

All intellectual property on this site, including without limit, the text, graphics and copyright works is owned by Appearance Coach (or the relevant content supplier). Appearance Coach is the exclusive owner of all rights in the compilation, design and layout of this site.

Right to use site and content
All content found on www.appearancecoach.co.nz is owned by Appearance Coach. No content, images or coding may be copied, downloaded, reposted, redistributed or altered without the express written permission from Appearance Coach.

Cookies

Portions of appearancecoach.co.nz make use of cookies, which are small files that are stored on your computer. These cookies are used only to manage the security and navigation process of the site. You may choose to block these cookies, but some portions of the site may not function correctly.

Content on or accessed through site

While Appearance Coach has tried to ensure the information on this site is current, accurate and complete, it does not guarantee such information will be current, accurate or complete when you access it. Appearancer Coach only provides the information on, or accessed through this site, on an “as is” basis. You must make your own assessment of the suitability of the content and/or the services for your own purposes. You are solely responsible for the actions you take in reliance on the information in, or accessed through, this site. If you are using this site or its content for business purposes, the above exclusions and limits will apply and the New Zealand Consumer Guarantees Act 1993 will not apply. Appearance Coach will take action to correct any error or inaccuracy which is brought to its attention, within a reasonable time.

Jurisdiction and governing law

This site and content has been prepared in accordance with the requirements of New Zealand law. These terms and any matters or disputes connected with this site will solely and exclusively be governed by New Zealand laws and will be dealt with exclusively by New Zealand courts.

Policy Changes

Appearance Coach reserves the right to modify this policy at any time, without prior notice. The most recent policy in effect will be posted at the site.

Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.

 

 

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

 

 

Additional non-returnable items:

 

 

  • Gift cards
  • Downloadable software products
  • Some health and personal care items

To complete your return, we require a receipt or proof of purchase.

 

 

Gift Vouchers are not able to be exchanged for cash.  If lost, Gift Vouchers are unable to be replaced.

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

 

 

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

 

 


Late or missing refunds
If you haven’t received a refund yet, first check your bank account again.

 

 

Then contact your credit card company, it may take some time before your refund is officially posted.

 

 

Next contact your bank. There is often some processing time before a refund is posted.

 

 

If you’ve done all of this and you still have not received your refund yet, please contact us at {email address}.

 

 


Sale items
Only regular priced items may be refunded. Sale items cannot be refunded.

 

 

Shipping returns

To return your product, you should mail your product to: Appearance Coach, C/0 Palm Villa, 8A Domain Road, Papamoa 3118.

 

 

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

 

 

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

 

 

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
